Food Contact Packaging Compliance: FDA, EU 10/2011, GB 4806

If you ship flexible packaging into a food brand or co-packer, the question "is this FDA-compliant?" will arrive on the first RFQ email. Food contact compliance is not optional - it is the legal gateway for any film, laminate or pouch that touches, encloses or is in close proximity to food. Get it wrong and the shipment is held at port, the brand is recalled, and the supplier is replaced.

XIAOPAI is the authorised global distributor of SINSTAR solventless laminating machines and a one-stop solution provider for the flexible packaging production line - so our clients face this compliance question every week. This guide explains the three frameworks most commonly asked about: the US FDA 21 CFR framework, the EU Regulation 10/2011 for plastics, and the China GB 4806 series for national food contact materials.

--------

1. WHAT COUNTS AS "FOOD CONTACT" MATERIAL?

--------

A food contact material (FCM) is any material intended to come into contact with food during production, processing, storage, transport or use. In flexible packaging this includes:

• Films and laminates (BOPP, PE, PET, CPP, PA, aluminum foil, paper)

• Adhesives used in solventless, solvent-based and extrusion lamination

• Inks and coatings

• Printing primers and overprint varnishes

The legal scope is not just "touching the food directly" - transfer of substances through vapour-phase migration, set-off inside a reel, and indirect contact via the inner layer of a multi-layer laminate are all within the regulated scope.

--------

2. THE US FDA FRAMEWORK: 21 CFR 174-179

--------

In the United States, food contact materials are regulated under Title 21 of the Code of Federal Regulations (CFR), specifically Parts 170-199. The most relevant parts for flexible packaging:

• 21 CFR Part 174 - General provisions for indirect food additives

• 21 CFR Part 175 - Adhesives and coatings

• 21 CFR Part 176 - Paper and paperboard

• 21 CFR Part 177 - Polymers (PET, PE, PP, etc.)

For a given film structure, the US importer typically submits a Food Contact Notification (FCN) or relies on a recognised prior sanction / GRAS status. Adhesives must comply with Part 175.300 (acrylic, polyurethane, etc.). The official text is the ecfr.gov consolidated CFR database - see FDA 21 CFR Part 174 for the regulatory chapter.

--------

3. THE EU FRAMEWORK: REGULATION 10/2011

--------

The European Union regulates plastic food contact materials under Commission Regulation (EU) No 10/2011, commonly called "the Plastics Regulation". It is a positive-list system: only substances explicitly listed in the Annex can be used in plastic layers that contact food. Key requirements:

• Overall Migration Limit (OML): 10 mg / dm square of food contact surface

• Specific Migration Limits (SML) for individual substances in Annex I

• Specific Migration Limit for the finished plastic: tested with food simulants A (ethanol 10 %), B (acetic acid 3 %), C (ethanol 20 %), D1 (ethanol 50 %), D2 (vegetable oil), under 10 days at 60 deg C or 10 days at 40 deg C

• Declaration of Compliance (DOC) must accompany every commercial shipment

• Functional barrier concept allows multi-layer designs to "shield" layers with limited clearance

The EUR-Lex official text - Regulation (EU) 10/2011 - is the legal source.

For adhesives the relevant piece is the Swiss Ordinance 817.023.21 (Annex 10) which is the de facto EU reference list for printing inks and laminating adhesives in many countries.

--------

4. THE CHINA GB 4806 SERIES

--------

China's national food safety standards for food contact materials are the GB 4806 series, administered by the National Health Commission and the China National Center for Food Safety Risk Assessment (CFSA). The main parts:

• GB 4806.1 - General safety requirements (General principles)

• GB 4806.7 - Plastic food contact materials

• GB 4806.8 - Metal food contact materials

• GB 4806.9 - Paper and paperboard

• GB 4806.10 - Coatings

• GB 4806.11 - Rubber

The GB 4806 series broadly aligns with the EU 10/2011 approach (positive list, OML 10 mg / dm square, SML per substance), with some differences in simulant recipes and approved substance lists. For multinational brands, the conservative path is to design the structure to satisfy the strictest of FDA / EU / GB and accept it as a global standard.

--------

5. HOW SOLVENTLESS LAMINATION HELPS COMPLIANCE

--------

Solventless lamination removes the residual-solvent risk that historically drove the most compliance headaches. In a solvent-based laminator, residual ethyl acetate (EtAc) can exceed 5 mg / dm square if the drying tunnel is mis-tuned - that is not compliant with EU 10/2011 OML and will fail the FDA extraction test. A well-tuned solventless line operates at:

• Residual solvent: typically below 1 mg / m square (often below detection limit)

• Adhesive coat-weight: 1.0-2.0 g / m square for general-purpose

• Curing: full reaction within 24 hours at room temperature (2-component PU)

6. HOW XIAOPAI AND SINSTAR ADDRESS COMPLIANCE

--------

XIAOPAI is the authorised global distributor of SINSTAR solventless laminators and an integrator of one-stop flexible packaging production lines. Our standard delivery includes:

• Recommended adhesive and primer chemistry for FDA / EU / GB compliance

• SINSTAR solventless laminator configured for the customer's end-application

• Document pack: Declaration of Compliance template, residual-solvent test plan, migration test plan reference

• Optional third-party lab coordination (Eurofins, SGS, Intertek) for OML / SML testing

We do not ship raw film or finished laminate ourselves - the film converter, brand owner or co-packer in your market is the legal entity responsible for the final migration test on the finished structure. Our role is to make sure the equipment and process window support a compliant outcome.

7. FAQ

--------

Q1: Does FDA "FDA-compliant" mean the same as EU-compliant?

A: No. FDA (21 CFR 174-179) and EU 10/2011 use different positive lists, different simulants, and different extraction time/temperature profiles. A structure can pass one and fail the other. The conservative approach is to design to the strictest and assume global market access.

Q2: Is a Declaration of Compliance (DOC) a certificate of safety?

A: Not exactly. A DOC is a supplier's statement that the product is built in compliance with the regulation. It is required by EU law for every commercial shipment of plastic FCM. It does not replace the migration test - which must be performed on the finished structure by an accredited lab.

Q3: How long is a migration test valid?

A: The test is performed on the finished laminate structure. If you change any layer - film grade, adhesive, primer, ink, even supplier - you must re-test. A common pitfall: the lab test is done on a pilot roll but production rolls use a different film lot.

Q4: Can I use a recycled PCR layer in food contact?

A: In the EU, recycled plastics need to be authorised under Regulation 282/2008 and a recycling process must be EFSA-reviewed. In the US, FDA has a separate list of authorised recycling processes. A "food-grade rPET" is not the same as a generic PCR layer. Confirm the specific recycling process before specifying.

Q5: Do I need GB 4806 testing if I only ship to non-China markets?

A: If the finished product enters China (re-export, Chinese brand owner, Chinese co-packer), yes. If you are a non-China converter shipping only to the US and EU, you generally follow FDA and EU. Many converters run all three frameworks as a baseline to maximise export reach.
